Should a collect balance be figured in total utilization?

I only have one CC w/ bal of $273/1500 Limit 5.5% util.
The problem is my only collection which shows begining bal of $5644 and bal of 5427.  But I have pd $3900 on time for last 13mths.  The high got to over $10,000 because of interest,crt cost, ect...Smiley Mad  The CA's seem to be using this Util of 96% in determining my overall util.  (1 Source Data my broker is using for my refi)  Anybody know how I can get the CA's to show the balance AFTER penaties?  That would bring down my util to 53% and an avg of 29.3%.  Or would that even be worth it.  I plan on seeing if they will except a settlement within 6 mths.

Wouldn't that be an 18.2% Util?

Your right Fraz!  18.2%.  For a avg of 33%.  Might mind is fried trying to get the refi this month!
