Seeking Advice on difficult situation: Late payments

Hi guys,

I am reaching out for advice on how to properly justify few missed payments on a previous vehicle loan(Jeep/US Bank). The delays were a result of a lemon case settlement and miscommunication between ourselves and Attorney's rep, not due to financial irresponsibility. We were under the impression from our Attorney to halt payments until hearing from FCA, which was a misunderstanding on our part. We are now facing the consequences of this confusion. However, case is closed and after consultation 

the attorney team is willing to provide an legal letter to support our case and eventually hoping to improve our chances of securing a new vehicle loan. However, we are unsure of what this letter should contain. We are seeking guidance on how to effectively explain this situation to potential lenders, emphasizing the unique circumstances that led to the missed payments.

Any assistance or advice on navigating this challenging situation would be greatly appreciated. Thank you for your help.

Can you provide some additional details regarding the legal situation ?   Was this related to vehicle manufacturer or some kind of defect ?   If so I'm not sure that your lender would be party to this, but any clarification you can provide would help.

In brief, our vehicle's suspension failed during its second month of use, leading to a cracked subframe. It took many months in the dealer's shop for repair, leading us to open a Lemon Law case in May last year. The case finally closed this month. Regarding our late payments, we were told (verbally) that the case would be handled by FCA and our lawyer's office, and we wouldn't need to worry about monthly payments or generating excess miles during the process. For about 4 months, we had to disregard emails and letters from the bank because we simply followed what the lawyer told us, who basically gave us the impression that we didn't have to make any payments during this time. However, a month after the case closed, we found out that we were expected to continue paying each month. By then, it was too late, and we realized that we had negative strikes on our credit record. In the meantime, US Bank was reporting us to the credit bureaus as late each month, while being under the impression that we should wait until the case is closed. Now, the lawyer is willing to cooperate by telling us, "Be glad to help as much as we can. What do you want me to write on the statement document so you can present it to US Bank and the credit bureaus?". Some people here say no letter will help, but we still have hopes.

Were you provided  a replacement vehicle whilst yours

was in repair ?

Is the car still yours or has it been purchased back by FCA?

FCA repurchased the vehicle and provided partial reimbursement for the monthly payments we had made over the course of a year. Although we are dissatisfied with the overall resolution of the situation, our main concern now is our credit score, which is preventing us from reaching out to another dealer. We are unsure of the next steps to take.…

Ok, so the Jeep is out of the picture now.  Have you paid US Bank everything  you had owed for the Lemon now?

Sorry to hear about your situation. It's my opinion that I'm afraid you unfortunately got (really) bad legal advice where it pertains to stop making your payments. This is a major mistake as there have actually been cases where the vehicle was repossessed, and subsequently the buyer was then barred from a lemon law claim because they no longer had possession of the vehicle to return to a dealer which is required for a claim. 

 

Perhaps there's a state law out there that's different, but in virtually any lemon law case, a borrower is still obligated to make all monthly payments on time unless, there is language in their loan contract that allows for this, OR, they received written confirmation that the manufacturer would make those payments on the borrower's behalf. This (the latter) generally doesn't happen. They will wait until there is a determination on buying the vehicle back. At that point they will reimburse the buyer as the law requires them to do, and as they did in your case.

 

I have no doubt your attorney has realized the snafu, hence their complete willingness to write whatever type of letter you want them to, to try and remedy the harm it's caused you. Perhaps a letter to USB from the attorney outlining your otherwise good credit history was only affected due to their misguided advice, which you took in good faith to be accurate, and the proper course of action, will result in USB granting a goodwill deletion of the adverse reporting. It may very well take several, ongoing attempts but I hope it works out in your favor.

At the dealership, the FCA representative who inspected the surrendered vehicle handled our check and assured us that he would send the pay off one overnight to USB. The only confirmation we have that everything is settled is that we are unable to access our USB account. I believe I should contact them to confirm all of the details.

In good faith, we followed the guidance provided to us, believing that it was the correct course of action until the Lemon Law case was resolved. However, we now understand that this was not the appropriate approach and of course we must take full responsibility for the late payments. That's why we decided to ask more experienced and knowledgeable than us people in this forum. All advice is greatly appreciated. Thanks.

Yes, if this can all be conveyed in to USB by the attorney and/or FCA would be ideal. Of course it equates to them admitting fault, and essentially taking full responsibility for the missteps, but after all, it's true that you only followed the advice of your attorney in addition to what you were told by the FCA rep.

 

The more facts that can be presented, in addition to coming from those who represented you, the more weight it may carry in swaying USB to grant goodwill deletion. 

 

EDIT: from what you describe here, and if the attorney is unwilling to admit fault. The alternative could be to consider a malpractice suit. A subsequent judgement in your favor from a court could also further prove the validity of your reasons for the late, or missed payments.

On their own, your explanation sounds great, but I'm trying to relay the fact that lenders hear all sorts of "stories" and explanations... all the time. The more "weight" your explanation carries, the better I think your chances of success are.
